Eviction Moratorium

Alameda County’s eviction moratorium ordinance, enacted to protect tenants impacted by the COVID-19 pandemic, ends 60 days after the end of the County health emergency. Legal evictions may start on April 29, 2023 and tenants who did not pay rent from April 29th onward may be at risk of eviction.

Tenants with unpaid rents accumulated during the moratorium may not be evicted for such unpaid rents but landlords may still pursue unpaid rent in small claims court. Tenants who violated their lease for other reasons than nonpayment of rent are subject to eviction and not protected from the nonpayment of rent clause.

AB 1482 took effect on January 1, 2020.

AB 1482 imposes rent caps on some residential rental properties in California. It also imposes “just cause” eviction requirements that apply after residents have occupied the unit for a certain period of time.

What is Alameda County's max allowable increase for properties not exempt from AB 1482?

For rent increases that took effect prior to 8/1/2021 = 5.3%

For rent increases that took effect on or after 8/1/2021 = 8.8%

Senate Bill 91 and Assembly Bill 3088 pauses evictions through February 28, 2023 for those who were financially impacted by COVID-19 and who cannot pay their rent during the pandemic. Renters must certify they were impacted and pay at least 25% of their cumulatively owed rent between September 1, 2020 and February 28,2023.

These protections apply to all residential tenants, including mobile home tenants, regardless of immigration status. Tenants must provide their landlord with a financial hardship declaration to access these protections.

.The County updated their eviction moratorium ordinance to extend until 60 days after the local health emergency is lifted. Local moratoriums will not be allowed any further extensions, and State protections will rule. the Moratorium is expected to expire on April 28, 2023.

SB 91 and AB 3088 do not apply to commercial unlawful detainers, meaning that commercial evictions can commence beginning September 2, 2020. However, the City’s locally enacted moratorium provides an extra layer of protection for commercial tenants.
